1. About this site

fabria.app is the public site of Derek Rodríguez Rodríguez, an independent developer who offers custom software services for SMEs and startups under the FabrIA brand. The site describes services and lets you get in touch to start a discovery process; it does not constitute a binding offer.

2. Acceptable use

By using this site you agree to:

• Provide truthful and up-to-date information in the contact form.
• NOT use the site to send spam, offensive content, or third-party information without their authorization.
• NOT attempt to compromise the site's security (unauthorized scanning, denial-of-service attacks, captcha evasion, etc.). These activities may be reported to the competent Colombian authorities.
• Respect the intellectual property rights of the published content (texts, diagrams, sample code).

3. Limitation of liability

The site's content (description of services, process steps) is informational. It does not constitute legal, tax, accounting or medical advice, nor a guarantee of a specific result for your business. The timelines and prices mentioned on the site or in initial conversations are estimates; binding terms are formalized solely through a written contract signed electronically (Ley 527 de 1999).

We make reasonable efforts to keep the site available, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance or respond to incidents without prior notice.

4. Intellectual property

The FabrIA brand, the site's texts, the visual identity and the frontend code are the property of Derek Rodríguez Rodríguez. Reproducing, modifying or redistributing them without prior written authorization is prohibited.

Any open-source code that may be published in public repositories (GitHub or others) is governed by the license indicated in each repository.

5. Status of the contractual clauses

When we move forward to a contract, the clauses are governed by FabrIA's internal legal governance system, with two possible states: draft_pending_legal_review (pending review by external counsel, NOT usable in productive contracts) and production_use_with_disclaimer (in productive use under an express statement that the sole operator accepts the residual risk + citations to the applicable Colombian law: Ley 1581/2012, Ley 1480/2011, DIAN regulations, Código de Comercio). The contract renderer only composes documents with clauses in the productive state.

The clauses injected into the contract you would receive to sign electronically (via clickwrap at /sign/...) are in the productive state and cite the applicable law; they have not been individually reviewed by external counsel and are accepted under this disclaimer.

6. Electronic signature

When you sign a proposed contract via the site's /sign page, that electronic signature has the same legal validity as a handwritten one under Ley 527 de 1999 (electronic commerce). The following are recorded as part of the contract: your name, date and time of acceptance, IP address and the browser's User-Agent. You receive a copy of the signed contract by email.

7. Data protection

The processing of your personal data is governed by our Privacy Policy (Ley 1581 de 2012 + Decreto 1377 de 2013).

8. Use of artificial intelligence

FabrIA uses language models (AI) as a support tool in its work process. When personal data is processed with AI, it is anonymized beforehand and the relevant decisions go through human review by the operator; the AI does not decide autonomously about you. The detail is in the Privacy Policy (section "Use of artificial intelligence").

If, in a project, you are delivered a system that includes AI features, the delivery documents which parts use it, their known limitations and the human-supervision recommendations. Responsibility for the use your end users make of that system is yours as the owner of the product.

9. Jurisdiction and applicable law

These terms are governed by the laws of the Republic of Colombia. Any dispute arising from the use of the site will be submitted to the ordinary jurisdiction of the civil courts of the city of Armenia, Quindío, unless Colombian law establishes a different non-waivable venue.
